Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern access to and use of ALPANDIA's products, including Realtime Voice Translation, AI Scam Detection, Voice Transcription, AI Whispering, Inappropriate Language Detection, Social Listening, and the underlying AI Voice Gateway, Telecom Integration, SIP Gateway, Edge AI, On-Premise AI, API Gateway, and SDKs (collectively, the “Services”). By creating an account, signing an order form, or otherwise accessing the Services, the entity or individual doing so (“Customer,” “you”) agrees to these Terms. Where a signed enterprise agreement or order form exists between Customer and ALPANDIA, that agreement controls to the extent it conflicts with these Terms.

2. The Services

The Services are enterprise infrastructure delivered via streaming API, webhook, SDK, and telecom integrations (SS7, VoIP, SIP), intended for use by businesses, carriers, financial institutions, healthcare providers, and government agencies — not for direct use by consumers. ALPANDIA may update models, features, and infrastructure over time to maintain or improve accuracy, latency, and security, provided such changes do not materially reduce the functionality Customer has purchased.

3. Accounts & API Access

Customer is responsible for its API keys, credentials, and the actions of its authorized users and administrators, including any configured Single Sign-On (SAML 2.0, OIDC) and role-based access controls. Customer must notify ALPANDIA promptly of any suspected unauthorized access. Sandbox and trial access may be rate-limited or throttled independently of production usage tiers.

4. Acceptable Use

Customer will not, and will not permit others to:

  • Use the Services to process audio or data it is not legally authorized to collect or transmit, including recording calls without required consent
  • Reverse engineer, decompile, or attempt to extract the underlying models behind translation, transcription, scam detection, or whispering features
  • Use AI Scam Detection or Inappropriate Language Detection outputs as the sole basis for an adverse action against an individual without human review
  • Exceed usage limits, rate limits, or concurrency tiers associated with its plan in a manner intended to circumvent fees
  • Use the Services in a way that violates applicable law, including financial services, healthcare (e.g. HIPAA), or telecommunications regulation

5. Customer Data

Customer retains all rights to the call audio, transcripts, translations, and other content it submits to the Services (“Customer Data”). ALPANDIA processes Customer Data solely to provide the Services and will not use it to train models shared across other customers. Handling of Customer Data — including encryption, data residency, retention, and access controls — is described in our Privacy Policy.

6. Service Levels

Production plans are covered by a 98% uptime SLA, with elastic auto-scaling designed to absorb traffic spikes (including up to 5× baseline load) without pre-provisioning. Where a signed order form specifies SLA credits or financial penalties for downside performance, those terms govern; absent such an agreement, Services are provided without uptime credits.

7. Fees & Payment

Fees are set out in the applicable order form or usage-based pricing published to Customer, and are billed on the agreed cycle. Except as required by law, fees are non-refundable. Late payments may result in suspension of API access after notice.

8. Intellectual Property

ALPANDIA retains all rights in the Services, including its models, software, SDKs, and infrastructure. Customer receives a limited, non-exclusive, non-transferable right to access and use the Services during the subscription term for its internal business purposes. No rights are granted to the ALPANDIA name, logo, or trademarks except as needed to reference authorized use of the Services.

9. Disclaimers

AI-generated outputs — including translations, transcripts, scam-risk scores, and language-detection flags — are provided on a best-efforts basis and may contain errors. Except as expressly stated in an order form or SLA, the Services are provided “as is” without warranties of any kind, and Customer is responsible for appropriate human oversight of decisions informed by AI outputs.

10. Limitation of Liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, or consequential damages, and each party's total liability arising out of the Services will not exceed the fees paid by Customer in the twelve months preceding the claim, except where a signed enterprise agreement specifies otherwise (e.g. for confidentiality or data-security breaches).

11. Term & Termination

These Terms remain in effect for as long as Customer maintains an active subscription. Either party may terminate for the other's uncured material breach following written notice. Upon termination, ALPANDIA will make Customer Data available for export for a limited period and will then delete or anonymize it in line with the retention terms in our Privacy Policy.

12. Governing Law

These Terms are governed by the laws specified in Customer's order form or enterprise agreement with ALPANDIA. Where none is specified, the laws of Customer's primary place of business govern, without regard to conflict-of-laws principles.

13. Changes to These Terms

ALPANDIA may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date above, and where required, Customer will be notified directly before changes take effect.
